Criminal Defense Results For Our Clients In Drug Cases
- Evidence suppressed and case dismissed where there was no reasonable suspicion for search of basement that led to the discovery of a marijuana grow operation. Our client was spared a significant potential jail sentence.
- Vehicle stopped for speeding. Our client was the front seat passenger. Officer ordered driver and our client out of the car and subsequently discovered marijuana in the vehicle. Our client was charged with illegal marijuana possession. We filed a motion to suppress evidence, arguing that the officer lacked a legal basis to order our client out of the car. The state relented and agreed to offer our client pretrial diversion, which ultimately led to dismissal of the charge. Our client has no criminal record as a result.
- Our client was stopped for speeding. Overly aggressive offer ordered our client out of the car, but it was just a routine traffic stop. Officer then searched the vehicle and discovered a significant amount of marijuana, leading to a felony charge, and a further search of our client's residence led to the discovery of an additional felony quantity of marijuana and a second set of felony charges in another county. We challenged the officer's actions with a motion to suppress evidence. The prosecutor agreed to reduce the charges and drop the case that stemmed from the search of our client's residence. Our client received a deferred sentence and was placed on probation. This means that if probation is successfully completed, the reduced charge is ultimately dropped and any record of the case is expunged and sealed so that, going forward, there is no criminal record stemming from the incident.
Gun Charges Dismissed In Federal Court
We recently won the dismissal of a felony gun charge for our client, who was charged in U.S. District Court with illegal possession of a sawed-off shotgun.
Background: Our client had been previously charged, in a related matter, with assault in state court. We did not represent the client in the state case. While he was awaiting trial in the state case, the sawed-off shotgun was found by local police after a search of his home. Possession of a sawed-off shotgun is a violation of federal law.
We uncovered the existence of a deal, in the state court case, to spare our client any repercussions if he allowed the search of his residence and the recovery of the sawed-off shotgun. However, despite the deal that was struck in state court, he was still charged in federal court. We filed a motion to suppress the recovery of the shotgun in federal court. When the existence of the state court deal was brought to the attention of the federal prosecutor, the federal charged was dismissed. This spared our client a lengthy prison term in a federal penitentiary.
Graffiti Artist Cleared Of All Charges
Our client was charged with causing property damage with graffiti art at a local hotel. We argued that he was stopped illegally by the police, without any responsible suspicion. The judge agreed that the officer had no reasonable basis for the initial stop of our client. As a result, all of the evidence in the case against our client was suppressed, and the charge was dismissed.
Not Guilty Verdict: Grossly Negligent Operation, Death Resulting
In an extremely serious case, attorney Richard Goldsborough won a not guilty verdict at a jury trial for our client, who was charged with gross negligent operation, death resulting. Our client was spared a lengthly prison term with this verdict.
